Police say Tiger beanie thugs' attack on men was 'vicious and brutal'

A father is preparing to undergo surgery following a vicious attack which saw his friend's face stomped on and fractured, as the pair left the Richmond and Hawthorn finals match.

Three attackers, one of whom was wearing a Richmond Football Club beanie, bashed the two men as they tried to hail a taxi on Wellington Parade in East Melbourne about midnight on Thursday.

Detective Senior Constable Ashlee Bull said there was some "banter" between the two groups of men as they walked from the match, when one of the three attackers kicked one of the victims.

The friends, aged 61 and 45, ran and hid in a laneway hoping the trio, who they had never met before, would leave the area.

But they were set upon as they walked back on to Wellington Parade to catch a taxi outside the Pullman Hotel.

"It's vicious, it's probably to the realms of the worst of what we sometimes see in these kind of assaults," Senior Constable Bull said.

"The stomping on the head, the stomping on the face, it's brutal."

Graphic footage filmed by a passerby shows the victims lying on the road being repeatedly punched, kicked and stomped on.

The man wearing a Richmond beanie allegedly punched the 61-year-old man at least 17 times in the head before stomping on him while the two others assaulted the 45-year-old.

The attack lasted for about a minute, police said.

Another passerby is seen unsuccessfully trying to stop the attack.

Both men were taken to hospital.

The 45-year-old, a father from Mount Evelyn, is undergoing surgery on his arm that was broken in the attack.

His friend, a 61-year-old father of two from Rosebud, who is seen in the front of the footage, suffered serious facial injuries, including a fractured cheek bone.

Senior Constable Bull said the older man's face was left battered and bruised.

"His whole head is swollen," she said. "They are very shaken up. They are very upset."

Senior Constable Bull said one of the victims was a Richmond supporter, while the other barracked for Melbourne.

She said it wasn't known if the dispute between the men was about the football match, but they had all been drinking at the game.

The three offenders ran off towards Clarendon Street and Fitzroy Gardens.

The gang were described as Caucasian and while one was wearing a Richmond beanie, another had an unidentified team's scarf on.

Commander Tim Hansen said the victims had been "severely assaulted".

"I've seen some pretty significant stuff in all my years on the job and this is right up there as far as brutality goes," he told radio station 3AW.

"Just everything you don't want to see in a brawl occurred in this fight."

He encouraged the attackers to turn themselves in as the footage was so clear.

THREE men were on Friday night in custody following a brutal attack on two footy patrons.

Two were arrested in Fitzroy North on Friday night and the third presented to Richmond police station.

It comes as the Victims of Crimes Commissioner calls for lifetime footy bans over the ugly assault, which followed a clash at the MCG.

Greg Davies called on the AFL to permanent match bans to those responsible for the “grotesque” assault following Thursday night’s Richmond and Hawthorn match.

Mr Davies said they must face the “most severe ramifications the legal and justice system can bring to bear.”

“These people are cowards. They are bullies,” he said.

“I’d like to see the AFL ban them from going to the football for life.”

Graphic footage shows the men punching a 61-year-old patron in the head 17 times and stomping on him.

His mate, 45, from Mount Waverley, was seen backing away with his hands up in surrender before being knocked to the ground and repeatedly punched.

The gruesome attack unfolded after midnight on Wellington Parade.

Both men are recovering in The Alfred hospital.

The 61-year-old, a dad from Rosebud, has serious facial fractures and head injuries.

His mate from Mount Evelyn may require surgery for a broken arm and has facial injuries.

Melbourne Crime Investigation Unit Detective Senior Constable Ashlee Bull said the cold-blooded attackers unleashed on the men for a full minute before “casually walking away”.

The attack unfolded after one of the victims was kicked and verbally assaulted by an offender while waiting for a cab outside the Pullman Hotel.

The pair ran for safety and hid from the trio.

They later returned to the taxi rank where they were ambushed.

“They are very shaken up and upset by what’s happened and are at a loss to explain why,” said DSC Bull.

.
Their head injuries are so severe they have been unable to tell investigators what provoked the attack.

Both parties had consumed alcohol earlier in the night.

Mr Davies, a former police officer, said the Australian culture appeared to have changed for the worse.

“It’s alien to anyone over the age of 40. If one of their mates kicked someone in a fight, they’d be wiped like a runny nose. Nowadays, it seems to be de rigueur.”

The trio split up after the attack and were last seen walking in opposite directions along Wellington Parade.

The three men arrested — a 27-year-old and 24-year-old from Fitzroy North and a 27-year-old East Melbourne man — were being questioned on Friday night.

Richmond Football Club refused to comment.

QC's sons accused of assault after AFL final set to fight the charges
Adam Cooper February 12, 2019 — 4.28pm

Two sons of a leading QC accused with a friend of viciously bashing two other men after an AFL final could fight the charges they face.

Brothers Dominic, 27, and Sam Walker, 25, and their friend Benjamin Fitt, 27, sat together in Melbourne Magistrates Court on Tuesday as their lawyers were granted permission to cross-examine the victims and six other witnesses at an upcoming committal hearing.

The Walker brothers, the sons of Tim Walker, QC, and grandsons of pre-eminent scientist and 2000 Australian of the Year recipient Sir Gustav Nossal, and Mr Fitt are accused of punching and kicking two men in Wellington Parade in East Melbourne, not far from the MCG, on September 7 last year, after Richmond beat Hawthorn in a qualifying final.

Graphic video footage recorded by a bystander shows a man in a Richmond beanie repeatedly punch and stomp on a man lying on the road, while two other men can be seen assaulting another man behind.

A scheduled committal hearing will determine whether they face trial and means the three men will either contest the charges or test the evidence against them before they enter a plea.

The two men who were assaulted, one aged in his mid-40s and one in his early 60s, are among the witnesses who will be questioned over a two-day hearing in late July.

One man suffered a broken arm and the other facial injuries including a fractured cheekbone.

They went to Wellington Parade to try to get a taxi and were confronted by the three accused men, police said at the time.

The three accused men each face nine charges including reckless conduct endangering life, recklessly causing serious injury in circumstances of gross violence, affray and intentionally causing injury.

Their lawyers were on Tuesday granted permission to cross-examine at least eight witnesses, including the two alleged victims, two doctors, the lead police investigator and bystanders.

The Walker brothers, of Fitzroy North, were supported in court by a woman, and Mr Fitt, of East Melbourne, left court with his father.

Magistrate Duncan Reynolds extended the trio's bail for them to return to court on July 29.

Walker brothers to admit 'vicious attacks' but won't face County Court
By Erin Pearson (theage.com.au)
Updated October 14, 2019 — 6.08pm first published at 2.14pm

Three men, two of them the sons of a prominent barrister, have pleaded guilty over a vicious assault outside the MCG after a magistrate decided the charges did not warrant sentencing before a County Court judge.

Melbourne brothers Dominic and Sam Walker, aged 28 and 25, and friend Benjamin Fitt, 28, fronted Melbourne Magistrates Court on Monday where the court heard a plea deal would see seven of the nine charges dropped.

They each pleaded guilty to two counts of intentionally causing injury.

The charges that were dropped included the more serious offences of reckless conduct endangering life, reckless conduct endangering serious injury and recklessly causing serious injury in circumstances of gross violence.

The Walker brothers are the sons of Tim Walker, QC, who on Monday supported his sons in court, and grandsons of pre-eminent scientist and 2000 Australian of the Year recipient Sir Gustav Nossal.

Throughout the day-long hearing Sam Walker glared at the media and smirked while helping pass notes between his father, who was sitting in the body of the court room, and his legal team at the bar table.

There were seven lawyers in court representing the three accused men.

The brothers and their friend had spent the evening of September 6, 2018, in the MCC members' area of the stadium watching an AFL finals match between Richmond and Hawthorn.

The court heard that shortly before midnight Dominic Walker was seen on CCTV cameras at the ground stumbling and appearing intoxicated before the trio left on foot, walking towards Jolimont station and Wellington Parade.

As they left they became involved in a argument with David Raeside and Leonard Tricarico, aged in their 60s and 40s respectively, before the Walker brothers made to leave in a taxi.

Shortly after that the brothers spotted Mr Raeside and Mr Tricarico near Mr Fitt and went to intervene.

Crown prosecutor Craig McConaghy said what followed was a ‘‘most vicious attack’’.

While Saw Walker was entangled with one victim, his older brother kicked the other to the head before dragging him along the ground and hitting his head onto the road 15 times.

Dominic Walker then yelled ‘‘I’m going to f---ing kill you, you’re going to be dead’’ before stomping on the man’s head three times, leaving him unconscious on the road with bleeding on the brain and a string of facial fractures.

The other victim was heard yelling ‘‘my arm is broken just leave me alone’’ during the 45-second assaults.

Lawyers for the three men argued that the Walker brothers had come to the aid of their ‘‘vulnerable’’ friend when the incident occurred and that there was no pre-planning nor weapons involved in the attack.

They told the court that their clients were all battling serious mental health conditions alongside drug and alcohol issues which had worsened after they finished at Kew's elite Xavier College.

Both Walker brothers now attend alcoholics and narcotics anonymous.

Dominic Walker now works for a crowd funding company and abstains from alcohol while his younger brother lays synthetic grass after a two-month stint in inpatient treatment and a bipolar diagnosis.

Mr Fitt submitted a written apology to the court in which he said he'd been left "horrified" by his actions and was committed to ensuring the behaviour was never repeated.

His lawyer Peter Morrissey said the 28-year-old was a gentle and vulnerable young man who'd gotten "quite drunk at the football, as many people do".

"The community does not need to put him in prison. There is a lot to like about Ben Fitt," Mr Morrissey said.

But the prosecution argued that mobile footage of the assaults made for confronting viewing and showed Mr Fitt inflicting blows as he moved from one victim to the other.

‘‘Most of [Dominic Walker’s] blows occurred when the victim was defenceless and being held. This was a most vicious attack that left the victim in an unconscious state,’’ the crown prosecutor said.

‘‘It is at the upper echelon of offending.’

"They must be sentenced for their actions on the night."

Earlier the men’s lawyers had argued that the charges should be heard in the Magistrates Court despite a push by the prosecution for it to be heard in the County Court.

Magistrates can impose maximum jail terms of two years on a single charge, or five years on multiple charges.

The charge of intentionally causing injury carries a maximum penalty of 10 years in jail if before a County Court judge.

Magistrate Duncan Reynolds granted the application and will hear the trio’s pleas.

Mr Reynolds ordered the trio be assessed for community corrections orders ahead of sentencing on October 22.
